Terms of service

1. DEFINITIONS AND TERMS

Seller – EXPRESS DIESEL SRL, headquartered in Bucharest, Sector 5, Soseaua Alexandriei, no.199F, postal code 051529, registered at the Bucharest Trade Registry under no. J40/1943/2000, Tax Identification Code RO12734370, Bank account RO22 UGBI 0000 6520 0020 1RON opened at Garanti Bank, Rahova Branch, Tel: 0214200433 / 0214200269 / 0214200364, Email: office@expressdiesel.ro, Website: www.expressdiesel.ro.

Buyer/User – any individual over the age of 16, legal entity, or any legal entity representative who places an Order or creates an Account on the Site and has agreed to the Terms & Conditions of the Site.

Goods and Services – any product or service listed on the Site, including those mentioned in an Order, which the Seller agrees to supply to the Buyer under the Contract.

Core/Old Part for Exchange – the old part handed over in exchange for the purchased product, which must meet the following conditions to be accepted:

  • Must be identical to the new part and match the part number.

  • Must not show signs of impact, cracks, breakage, deformation, rust, corrosion, burn marks, damaged threads.

  • Must not be dismantled or missing components (incomplete).

  • Connectors or plugs must not be cut or damaged.

  • The old part must be returned in the original packaging of the purchased part.

Order – an electronic document that serves as communication between the Seller and the Buyer, through which the Buyer expresses intent to purchase Goods or Services via the Site.

Commercial Communications – any type of message (e-mail, SMS, telephone, push notification, etc.) containing general or promotional information regarding similar or complementary products, offers, promotions, or items added to the Buyer’s “Account/Cart”.

Account – the section of the Site consisting of an e-mail and password that allows the Buyer to place Orders and stores Buyer information and order history (Orders, invoices, etc.). The Buyer is responsible for ensuring all information provided when creating the Account is correct and up to date.

Contract – the distance sales agreement concluded between the Seller and Buyer without the simultaneous physical presence of both parties.

Content – includes:

  • All information on the Site accessible electronically;

  • Content of e-mails sent by the Seller;

  • Any communication made by Seller representatives to the Buyer;

  • Information regarding Goods/Services or their pricing;

  • Data about the Seller or its privileged partners.

My Cart – the section of the Account where the Buyer/User can add Goods or Services intended for purchase.

Document – these Terms & Conditions.

Site – the online store hosted at www.expressdiesel.ro and its subdomains.

Specifications – all technical details or descriptions of Goods and Services as stated in their listing.

Core Charge – the value of the old part for exchange, invoiced and paid along with the purchased product.

Transaction – the collection or reimbursement of an amount resulting from the sale of a Good or Service by the Seller, using the approved payment processor.

2. CONTRACTUAL DOCUMENTS

2.1. By registering an Order on the Site, the Buyer agrees to the form of communication (phone or e-mail) by which the Seller conducts business operations.
2.2. The notification received by the Buyer after placing the Order is informational only and does not represent acceptance of the Order.
2.3. The Seller reserves the right to modify the quantity of Goods/Services in an Order. In such cases, the Buyer will be notified and reimbursed accordingly.
2.4. The Contract is considered concluded once the Buyer receives electronic or SMS confirmation of shipment from the Seller.
2.5. For Orders picked up at the Seller’s location, prices and reservations are valid for 48 hours.
2.6. The Contract is based on the information available on the Site, supplemented by the warranty certificate issued by the Seller or its supplier.

3. ONLINE SALES POLICY

  • Access to place an Order is permitted to any User/Buyer.

  • The Seller may restrict a User’s/Buyer’s access if their conduct may harm the Seller.

  • Communication with the Seller can be done via the contact information on the Site.

  • In case of unusually high traffic, the Seller may require CAPTCHA validation.

  • The Seller may publish information on Goods/Services or promotions available within stock limits.

  • Prices are displayed in RON and include VAT.

  • The Seller is not responsible for additional fees charged by banks (e.g., currency conversion).

  • Product descriptions (images, videos, presentations) are for presentation only and are not contractual.

4. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

All Site content (logos, images, text, multimedia, etc.) is the exclusive property of the Seller. Copying, modifying, or using this content without express written permission is prohibited.

5. ORDER

  • Orders can be placed by adding Goods/Services to the shopping cart and completing payment.

  • Adding a product to the cart without completing the Order does not constitute a purchase or reservation.

  • By finalizing the Order, the Buyer confirms that all data provided is correct and consents to the Seller contacting them if needed.

  • The Seller may cancel Orders in cases such as payment failure, invalid transaction, or incorrect Buyer data.

6. RETURNS

  • According to OUG 34/2014, the Buyer (consumer only) has the right to withdraw within 14 days without providing a reason, bearing only the return shipping costs.

  • Returned products must be in their original condition, with packaging, accessories, labels, and documents.

  • Refunds are issued within 14 days of receipt of returned products, via the original payment method.

  • Gifts received with products must also be returned.

Exceptions to returns include:

  • Services fully performed;

  • Products showing signs of assembly, modification, or damage;

  • Products without original packaging or missing components.

7. WARRANTIES

  • Products are covered by a 12-month warranty (unless otherwise stated), according to Romanian law and manufacturer policies.

  • Warranty covers manufacturing or material defects, not damages caused by misuse, improper installation, or external factors.

  • Warranty claims require submission of purchase invoice, warranty certificate, installation documents from an authorized workshop, and diagnostic reports.

  • Warranty resolution is within 15 calendar days; if manufacturer checks are needed, up to 30 working days.

The Seller is not liable for damages resulting from product misuse or failure to fulfill Buyer responsibilities (e.g., incorrect account data).

10. CONFIDENTIALITY & DATA PROCESSING

11. FORCE MAJEURE

Neither party is liable for failure to fulfill obligations caused by force majeure. If the event lasts more than 15 days, either party may terminate the Contract without damages.

12. GOVERNING LAW & JURISDICTION

This Contract is governed by Romanian law. Any disputes will be resolved amicably or, failing that, by the competent courts of Bucharest, Romania.
